Chairman Loveitt opened the meeting at 4:04 pm.

Roll Call Present: Chairman Loveitt; Councilors Dugas, Justice, Phinney, and Hamblen; Town Manager, David Cole, Town Clerk, Christina Silberman, and Town Attorney William Dale. Absent: Councilors Willett & Robinson

Item # 7143 Moved by Councilor Justice, seconded by Councilor Phinney and Ordered that the Town Council of the Town of Gorham, Maine, in Town Council assembled appoint Phil Dugas as its representative to serve on a Committee to name the Middle School Auditorium. 5 yeas.

Item #7144 Chairman Loveitt asked to have a brief discussion regarding parking on Cross Street. There is a property for sale in this area and Chairman Loveitt feels there may be an opportunity to improve parking issues if the town were to purchase this property. He asks to pursue this issue and report back with his findings if there are no objections from fellow councilors. There were no objections.

Item #7145 Moved by Councilor Dugas, seconded by Councilor Phinney and Ordered that the Town Council of the Town of Gorham, Maine, in Town Council assembled amend the Retirement and Compensatory Time section of the Town’s Personnel Policy as presented. 4 yeas, 1 nay (Hamblen).

AMENDMENTS TO PERSONNEL POLICY

RETIREMENT

C. Employees may begin making contributions to the program commencing with their first day of employment. However, for the first six months of employment, the Town will not make contributions on behalf of the employee. However, After six months of employment the Town matches contributions made by regular employees who work 30 hours or more a week and grandfathered regular part-time employees up to a maximum amount equal to five seven (7%) percent of an employee’s salary. For example, if Employee A contributes two percent (2%) of his salary, the Town will match the employee’s contribution with two percent (2%). If Employee B contributes five seven percent (5%) (7%), the Town would contribute five percent (5%) seven percent (7%). Effective July 1, 2006, the Town’s matching contribution will be seven and one-half (7.5%) percent.
Employees may contribute more than five percent seven percent (5%) (7%) of their salary. However, the Town’s matching contribution will not exceed five seven percent (5%) (7%).

COMPENSATORY TIME

Exempt employees shall not be eligible to accumulate compensatory time.

Department Managers and other FLSA-exempt employees occupy positions of responsibility, accountability, and discretion. They may be required to work outside the normal schedule of working or office hours and are compensated, in part, on the basis of accomplishing the tasks demanded of the position without regard for the specific number of hours worked. They are also expected to be accountable for their time, be available to the public and other staff, and generally to conform with normal operating hours. Exempt employees may take discretionary time off without charging such time off to sick or vacation leave:

1. when it does not interfere with the operations of their department or office.
2. when there are no other priorities which should be completed which, if not completed, might interfere with the operations of another department, and
3. for absences of more than one-half a work day, when the employee receives the permission of his/her department manager; or, in the case of department managers, the Town Manager.

Absences of one-half day or less may be taken at the discretion of the employee, subject to the review of the department manager; or, in the case of department managers, the Town Manager.

Item #7146 Chairman Loveitt invited public comment on this item. Two individuals indicated that they wish to resolve this issue. Moved by Councilor Justice, seconded by Councilor Phinney and Ordered that the Town Council of the Town of Gorham, Maine, in Town Council assembled go into executive session pursuant to Title 1, M.R.S.A., Section 405 (6)(E) to discuss an offer to settle litigation. 5 yeas.

Moved by Councilor Phinney, seconded by Councilor Dugas and VOTED to come out of executive session at 5:35 p.m. 5 yeas.

Moved by Councilor Dugas, seconded by Councilor Phinney and VOTED to adjourn. 5 yeas.
